1.      GUIDANCE NOTES - PLEASE READ

1.1   Your valued custom is important to us and we want to satisfy your purchasing requirements. These Terms and Conditions of Sale ("the Terms") are important and should be considered carefully before you place an order. 

1.2  These Terms have been designed to protect your rights as a customer and to protect our rights as a    business and to create the basis of an understanding between us.

1.3  The Terms apply to all transactions carried out on the airssential.com.au website. Should this not be the case we will indicate "this applies to website sales only".

1.4  Please note carefully Section 3 which refers to our Returns Procedure.

1.5  If you have any questions relating to the Terms, please e-mail us at  betterhealth@boian.com or phone  The Airssential Customer Care Centre on Free Call 1 800 026 426 between 9am and 5pm Monday to Friday, excluding public holidays, quoting your invoice number for reference.

1.6  For purposes of the Terms "we", "us", "our" refer to airssential.com.au and "you" and "your" refer to you the Customer unless the context clearly indicates otherwise. 

 

2.     PURCHASING FROM US 

2.1   To purchase from us you must be 18 years or older.

2.2  We are not obliged to supply the goods or services to you until we have confirmed acceptance of your order. It is on our acceptance that a contract comes into effect between us.

2.3   Ownership for the goods transfers once full payment has been received and delivery has taken place.

2.4  All products are supplied subject to availability. In the event that we are unable to supply any product, we will inform you of this as soon as possible.

2.5  Occasionally a manufacturer may change the specifications of a product. Should this happen to a product you have ordered from us we will endeavor to offer you a substitute product of no less specification and equivalent price. If you are unhappy with the replacement you can return it by contacting Customer Service.

2.6   All sizes and dimensions are approximate but we make every effort to ensure they are as accurate as possible. 


3.
     RETURNS PROCEDURE 

3.1  We hope that you will be completely satisfied with your product. However, in limited circumstances it may be necessary to return your product to us. Please ensure that you follow these instructions for returning a product to avoid a delay in processing your return. Other than as required by law we have no general policy of accepting returns.

3.2  Returns will not be accepted unless they have a Returns Authorisation Number on the label. This number can be obtained by contacting Customer Service.

3.3  You the Customer are solely responsible for inspecting the product upon delivery. You must contact Customer Service should you wish to inform us of damaged, defective or missing goods and/or delivery discrepancies within 48 hours of your delivery being made.

3.4  When sending a return to us, you are responsible for the safe carriage of the product back to us (except where the product is faulty when we will arrange for collection of the product). 

3.5  Any product returned to us must be returned in unused and re-saleable condition in original, undamaged  packaging. This may require the item to be packed into an outer carton for protection of the packaging during transit. 

3.6  Refunds will be processed within thirty [30] days from the date you tell us of a product return. Refunds will not be issued until the product has been received by us in its original or delivered state.

3.7  You should return any product to us via a suitably insured means based on the value of the product. This means that the full value may be recovered by you if the product is lost or damaged. You should retain any receipt confirming the return. If returned products are lost we will not be liable for them.

3.8  To cancel an order prior to its dispatch, please call Customer Service.

 

4.      ORDERING BY TELEPHONE

4.1  Airssential is pleased to accept orders by telephone. Please phone you order to customer service on our Free Call number between 9.00am and 5.00pm Monday to Friday.

 5.      DAMAGED, DEFECTIVE OR FAULTY GOODS 

5.1  Any product supplied to you must be used for its intended purpose and not be subject to abuse or unreasonable usage.

5.2  Airssential will replace any product that has failed in normal usage as long as the product has been used as intended and does not, on examination, display any signs of misuse.

5.3  Should you need to return a product due to an error on our part we will exchange or refund the product for you. We will also refund any reasonable associated carriage costs.

 6.       UNWANTED OR INCOMPATIBLE GOODS 

6.1  We are not obliged to accept the return of a product unless it is damaged or faulty.

6.2  We are entitled, subject to our discretion, to accept products that are unopened and unused subject to the deduction of a handling and administration fee of 20%. To find out whether this will be possible, please contact Customer Service.

6.3  Should we authorise the return of an unwanted or incompatible product, you are responsible for the cost of safe carriage back to us. We recommend appropriate insurance to cover return freight is organised. 


7.
      PRICES AND PAYMENT 

7.1  Where limited offers are advertised, these products are subject to availability and are allocated on a strict first come first served basis. When all the stock of these products has been allocated, no substitute product will be offered.

7.2  The price you pay is the price displayed on this website at the time we receive your order apart from the following exception. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

7.3   Payment can be made as specified below:

7.4  Item costs are quoted in Australian Dollars (AUD). For aproximate conversions, use website www.xe.net.

7.5  Australian buyers automatically have GST and any shipping/handling costs included in the purchase price. Some medical items are GST exempt and pricing shown on these products reflects this.

7.6  We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

8.    DELIVERY TO YOUR DOOR

8.1  Airssential is committed to providing the best possible service and believes that short delivery times are integral to this. All orders placed during business hours are picked and dispatched the same day to ensure your purchase arrives to you as soon as possible.

8.2   Standard ground shipping is our main form of cost effective delivery to anywhere in Australia.

8.3   A signature is required by all the carriers except Australia Post, upon delivery of goods. Couriers and Australia Post will leave a card if you are not at home when they call.

8.4   Cost of shipping is calculated by "weight and destination postcode". Your delivery prices start as low as $6.60. Shipping costs for additional items are calculated by weight and added to the cost of the first item.

8.5  Delivery Times:                     NSW, QLD, VIC allow 1-3 Working Days.

                                                   SA, W.A, NT, NQLD, TAS allow 5 Working Days.

 

     Depending on where you are located, the location of the warehouse where that particular item is held and if the product is in stock will determine a shorter timeframe.

8.6  Delivery is normally within the above timeframes. Every effort is made to deliver goods within the timeframes however supply chain issues, which are beyond our control, occasionally cause delays. We will endeavor to keep you informed of any delay to your expected delivery date.

9.     BUSINESS CUSTOMERS

9.1  Wholesale orders may be placed on this website by entering your account details. Once your order is confirmed delivery is as per Section 8 above. Orders above AUD 300.00 are dispatched freight free. 

9.2  Incorrectly ordered goods will be accepted for return subject to a 15% handling fee. Returns will not be accepted unless they have a Returns Authorisation Number on the label. This number can be obtained by contacting Customer Service.

9.5  If you have a credit account with us payment is due not more than thirty [30] days after receipt of our statement.

10.   DATA COLLECTION, PRIVACY & SECURITY  

10.1 Airssential Life Care is committed to protecting the security and privacy of your personal information. Information security and privacy is very important and we use several security measures to protect your personal information from unauthorized access or disclosure.

 

      Please note, all credit card transactions are handled separately through an online PayPal merchant facility for increased security. 

10.2  When you visit our website our web server routinely collects certain non-personally identifiable data about your visit including your domain name or IP address, the browser and the operating system used, the time of the visit, pages visited and any links followed to or within the web site.

       If you use services provided on our website we may request you provide information about yourself including your name, address and details of how we can contact you. This information is generally required to enable us to fulfill the service you have requested effectively and to notify you of promotions and announcements if you have previously provided your permission. No other personally identifiable information is collected from you without your knowledge. Your personal information will not be sold onto third parties.

       Software to measure and audit web site activity is used on this site. The information collected shows the number of visitors to the web site, the pages viewed and length of the stay on the web site. Common entry and exit points may also be identified. This aggregated, non-personal information is collated to assist in analyzing the usage of the website with a view to improving website navigation and content.

10.3 Personally identifiable information collected from you is used to fulfill the service you have requested, such as a purchase or an enquiry. If the information is to be used for any other purpose this use will be clearly stated at the time the information is collected. If the information provided is not necessary to fulfill the service, completion of the details will be optional.

       Fulfillment of the service may require your personally identifiable information to be provided to a third party such as a service provider e.g. the freight forwarder in the case of a purchase.


11.
    GENERAL

11.1 We will not be liable for any claims which arise from the supply of our products to you beyond the warranty replacement of a defective product. Boian Surgical shall not be liable to the purchaser or others for loss of equipment use or for indirect, incidental or consequential damages caused by the breach of any express or implied warranty.

11.2 These Terms cannot be altered or suspended, permanently or temporarily, without the written permission of a member of the Board of Directors of Boian Surgical Pty Ltd.

11.3 These conditions are subject to Australian law and the jurisdiction of the Australian courts
